Q : My husband was hurt on the job back in 2005, he was rear ended by a forklift type machine, and as a result his L5 disk was injured. The surgery performed only removed the fragments of the disk, and nothing else. Post surgery, my husband always complained of pain in his left leg. During a QME visit, he told the QME of his problem, however the QME listed his pain as minor discomfort. In 2009 his pain worsened, and he had to use a cane to help him walk. The end result was my husband had to have surgery in same area as before, but this time L4 was worked on and pins and screws were added to his back. Although this is a worker's comp injury, was there some negligence on the part of the first doctor? We live in California.
