Q : How long does a surety have to send payment on an undisputed claim under SF 25A? Also, can you file a suit against the company for the disputed amount due? Please help.
A : Since a surety assumes another's contractual responsibility, then they must generally send payment until the entire undisputed amount is received. If the surety and the company disagree upon the amount due, bringing a lawsuit can be option. Please consider asking local counsel for further information.
