Q : The company that I have been working for has closed. I was told I should receive my final paycheck within 48 hours of closing ( per Louisiana law ) and pay should be in the form of check ( not direct deposit) After being told several times that I would receive a final paycheck via us mail, I was given a direct deposit within normal pay schedule, however, I was not paid the full amount owed. Company corporate headquarters is not in La. but I worked in La. I wanted a hard check rather than direct deposit, because my existing account for my direct deposit has been compromised via internet hacking. What are my rights?
A : Louisiana Revised Statute Section 23:631discusses payment after termination of employment. This section generally applies to laid off employees also and specifically states that "[p]ayment shall be made at the place and in the manner which has been customary during the employment."
