Q : My daughter and my one year old grandson are renting a home that is going to be forclosed very shortly, how long can she stay there leagally before the sheriff locks the property?
A : No sheriff may lock a property without a court order, and that won't happen without a formal eviction action. If and when the lender forecloses and becomes the owner, your daughter is entitled under new federal law to a 90-day termination notice. If she has a long-term lease and the lender ultimately sells the place to someone who intends to occupy, she's still entitled to a 90-day notice after that sale occurs. (If she has a long-term lease and has to get out before the end of the term, she is free to go after the landlord for breach of contract and related damages.)
