Q : I have an employee that had a hernia before he worked for me that i did not know about, now he has ruptured it and has had surgery. I don't hear from him for two weeks ,then i get a call from his attorney I am being sued for all kinds of things I don't have workmen comp. what the best action to take? thank you for your time
A : GET A LAWYER! If your unidentified state requires you to carry workers comp, you may well find yourself not only personally liable for his injuries but paying serious fines to the state for noncompliance.
