Necessary help about Probate Property
Q : Please bare with me. I'm not sure if I'm posting this question in the appropriate listing. My Father recently past, and was engaged to be married. He lived with his fiance and the land and home are hers. All of his worldly pocessions are on her property, including a small business. I was not elidgible to become an executor for his estate, however, my brother and sister were. They have already been through the court proceedings and since been named such. The fiance has denied both of them access to her land and home to make an inventory or to take care of the small business responsibilities or accomplish estate tasks. My question is , what are the legal steps that they ,the executors, need to accomplish to be able to take care of what they need to ? They have acquired an attorney, had since the very start. What rights does a fiance have ,other than on her property, to deny information and property when there is a will naming us children as sole beneficiaries and rights to become executors of his estate? A : Not the right board, but never mind. Your brother and sister need to talk with the estate-probate attorney about getting a court order for access to your father's property and meanwhile sending the fiance a letter advising that if any of his stuff goes missing, the estate will pursue the matter. If the attorney they hired can't handle this, then they need to discuss it with another attorney. The fiance doesn't have to provide "information" as such. The fiance has no right to the estate if there's no will leaving property to her (that said, hopefully she has no credible argument that he GAVE certain things to her; anything that has a title attached to it, obviously, you'd expect to see documentation that he transferred ownership to her).
