Q : My friend was given a drug for a condition she did not have in 2004. She became disabled immediately as she had chest pain,bone pain, memory loss and many side effects. She is a professional, she had horses beside working and showed on week ends. She was in excellant shape. She is still disabled however I have read her doctor's reports and upset how she was treated. She went to a well known doctor in Texas, he was familiar with the drug and was shocked it had been given to her as she has bad drug allergies, beside her not needing it..A sample of her diagnosis was- needs a Psychologist, mood disorder(this from a doctor who spent 10 minutes with her and never addressed her swollen blue legs and she could not urinate, another doctor wrote she wants drugs and her mother helps her. The drug she had been given was for women with endometrosis, she did not have endometrosis, now after five years of losing everything she just found out her inside were full of scar tissue.She had complained to all the doctors about the lump in her body and they all said it was a muscle. Five years of pain and losing her farm,show horses and has not been able to work at her job she loved. The lack of standard of care,holding back pain meds until she had a very high blood pressure to the point I was so scared she would have a stroke She was in the hospital many times as the drug wiped out her immune system.One of the doctors filling in for her PCP when she was in the hospital was actual mean to her and rude to me. If these doctors and there were many could not find out why she was in so much pain they at least owed her kindness and caring.. I need to know if she has a case due to the fact the reports were totally wrong. PS I am her mother and had to stay with her 24/7. I have lost my time for an enjoyable retirement and trying not to lose my home.I also know about the statute of limitations.
A : The statute of limitations in TX for bringing a medical malpractice action is 2 years from the date of injury. That time expired 3 years ago.... Consult local counsel.
