Q : Back in the 1980s/90s a small British Company invented a machine which they marketed in the U.S. They did not patent it in the US. A U.S. company has reverse engineered the machine and are marketing it under the original name used by the British company that went out of business. The question is does the original inventor have any rights in respect of this situation. My follow on question re the above is am I correct in assuming that the original inventor/manufacurer, they are one and the same, has the right to re-commence manufacturing and marketing the product himself using his original name for the product, which is now being used by the company that reverse engineered it?
